Alan M. Lubiner

Mr. Lubiner served as an Immigration Officer and Attorney for the Immigration and Naturalization Service for six years. He served as a Special Assistant U.S. Attorney assigned to special proecutions and has assisted in the drafting of Immigration legislation for the Select Commission on Immigration in Washington, D.C. Mr. Lubiner is the co-author of Immigration Made Simple and Citizenship Made Simple and has lectured extensively on Immigration issues. He is a former Chairman of both the New Jersey Chapter of the American Immigration Lawyers Association (AILA) and the New Jersey Bar Association's Immigration and Nationality Section. He also worked as a Securities Analyst for Manufacturers Hanover Trust in New York City. Mr. Lubiner holds a bachelor's degree in Banking and Finance from NYU and a J.D. from Brooklyn Law School. He is admitted to practice before the Supreme Court of the United States, as well as in Federal and State courts in New York, New Jersey, and Pennsylvania. Mr. Lubiner has two published decisions from federal court on Immigration issues and is an AV-rated attorney.
 

David W. Schmidt

David W. Schmidt began his career as a Prosecutor in New York City. Thereafter, in 1984, he established Lubiner & Schmidt with Mr. Alan Lubiner. For over 20 years, the focus of Mr. Schmidt's practice has consistently been in the area of litigation, first in State and Federal Court in New York and New Jersey, and for more than a decade in securities arbitration forums such as the NASD and the NYSE.

Mr. Schmidt's state and federal experience has included the trials of complex criminal and civil matters. In the era before Shearson/American Express, Inc. v. McMahon, 482, U.S. 220 (1987), and the advent of, almost, universal arbitration of securities cases, he handled these matters in State and Federal Court. In the aftermath of McMahon, which upheld the enforceability of arbitration agreements, Mr. Schmidt has handled hundreds of securities arbitrations on behalf of firms and individuals alike.

Mr. Schmidt was one of a select group of lawyers asked to handle expedited arbitrations on behalf of a National Broker Dealer as administered by the Securities and Exchange Commission. Mr. Schmidt has also represented firms and senior personnel with regard to matters pending before the Securities and Exchange Commission and self-regulatory organizations. Mr. Schmidt is presently regional counsel to several major brokerage firms and oversees all litigation handled by Lubiner & Schmidt.
 

Alan J. Pollack

Mr. Pollack was admitted to the Bar in 1994 and is admitted in both New York and New Jersey. He graduated with a B.A. degree from the University of Michigan and earned his J.D. from Brooklyn Law School. Mr. Pollack has ten years of experience specifically in Immigration practice and was an associate at some well-respected business immigration law firms before establishing Baron & Pollack, PC. in 1999. He joined our team at Lubiner & Schmidt in 2004 and now leads the deportation and litigation aspects of our Immigration department. Mr. Pollack has experience with both business immigration and deportation. He is a member of the American Immigration Lawyers Association (AILA) and recently served as the Chairman of AILA's New York Chapter Asylum Office and Immigration Court Liaison Committees. He is currently the Chairman of the Chapter's Ethics/Unauthorized Practice Committee. He previously served as a member of their Department of Labor Liaison Committee. Mr. Pollack has assisted in the preparation of published articles on immigration law and has appeared several times on local television on NBC News (Channel 4) discussing immigration issues. He has two published Immigration decisions, one on the ability to pay, and the other on asylum. Mr. Pollack also has a bi-weekly live talk-radio show on Immigration on Asian FM, which airs in several major cities across the country.
 

Kenneth O'Connor

Mr. O'Connor handles securities litigation and arbitration before the National Association of Securities Dealers and New York Stock Exchange on behalf of major Wall Street broker-dealers. Mr. O'Connor received his Bachelor of Science degree, magna cum laude, in 1979 from Fairleigh Dickinson University, his Doctor of Dental Medicine degree from the University of Medicine and Dentistry of New Jersey in 1983, his Certified Financial Planner designation in 1991, and his Juris Doctorate from Seton Hall Law School in 1994. Mr. O'Connor was a member of the Editorial Board of the Seton Hall Constitutional Law Journal where his article "Funeral for a Friend: Will the Seventh Amendment Succumb to a Federal Cap on Non-Economic Damages in Medical Malpractice Actions?" (4 Seton Hall Const. L.J. 97) was published. Prior to joining the firm, Mr. O'Connor maintained a civil trial practice in southern New Jersey. He also served as General Counsel to several healthcare related corporations. Mr. O'Connor is licensed to practice both law and dentistry in the states of New Jersey, New York, and Pennsylvania.
 

Jennifer Woods Burke

Ms. Burke focuses her practice on the representation of institutions and individuals in the prosecution and defense of claims brought under federal and state securities laws. She handles litigation in federal and state courts, SEC and NYSE enforcement actions, regulatory and state investigations, and arbitrations before the National Association of Securities Dealers and New York Stock Exchange. She also handles disputes over customer accounts and provides general counsel advice to corporate clients. Her practice includes the representation of institutions and individuals in the defense of employment related complaints. Before joining the firm, Ms. Burke worked at Merrill Lynch Pierce Fenner & Smith, Inc., representing the Firm and employees in regulatory inquiries and arbitrations. Prior to that, Ms. Burke was affiliated with various other brokerage houses and government agencies including the New York State Office of the Attorney General - Investor Protection Bureau. Ms. Burke holds a law degree from New York Law School, which she attended on academic scholarship. She was an Associate Editor of the New York Law School Journal of Human Rights. She received her bachelor's degree in political science from Providence College in Rhode Island. Ms. Burke is admitted to practice in New York and New Jersey (Florida admission pending).
