A New Law Signed by New Jersey Governor Could Make You Eligible for an Expungement IMMEDIATELY!

Do you have a criminal conviction on your record that has made it difficult to gain employment? As of January 19, 2016, New Jersey law makers seem to agree. The governor of New Jersey, Chris Christie has signed into law a measure that will greatly modify the current expungment statute (N.J.S.A. 2C:52-1) in New Jersey. The new bill, A206, is solely designed to ease the path toward obtaining an expungement by decreasing waiting periods.

Specifically, if you were convicted of an indictable offense you would typically have to wait 10 years from the date of the conviction, payment of a fine, successful completion of probation or release from prison, whichever is later. With this new law in effect, the weighing period has been cut in HALF to 5 years. Meaning you may be eligible for an expungement NOW! For example, if you have a conviction for an indictable offense from 7 years ago you would have had to wait 3 more years to be eligible for an expungement. However, the new law allows you to petition for an expungement IMMEDIATELY... No more waiting!

Chances are if you have a criminal conviction from 2011 you were under the impression you could not apply for an expungement before 2021. That is not the case anymore. You may be eligible for an expungement TODAY.

Similarly, if you were convicted of a disorderly persons or petty disorderly persons offense in the past, the waiting period before you can apply for an expungement used to be 5 years. It has now been reduced to 3 years. For example, if you have a disorderly or petty disorderly persons offense from 2013 you would not have been eligible for an expungement until 2018.
